Brokers - Immediately Address Section 8 Housing Discrimination

Brokers and agents must immediately address Section 8 housing discrimination.  “Testers” or internet trolls are actively looking for violations to prove that housing discrimination still exists.  In some cases, testers are emailing agents asking one simple question, “Do you accept Section 8?”

The answer is, “Yes”.  Miami-Dade and Broward Counties prohibit discrimination based on “source of income”, which includes Section 8 Housing Choice Vouchers, under Sec. 11A and Sec. 16 ½ of the county codes, respectively. 

In the past months, a “tester” has filed over 40 lawsuits in South Florida as a result of website advertisements that stated, “No Section 8”.  You should immediately educate every agent in your company:

• Do not advertise “No Section 8” or anything similar.
• Respond, “Yes, we accept applications from all prospective tenants”, when asked if you or the owner accept Section 8 Housing Choice Vouchers.
